The deadline, and what it depends on
It depends only on your last day. Weekends do not count toward the deadline; public holidays can push it later still.
If you quit, final pay is due on the next regular payday that is at least 3 days after your employer received your notice. An employer that paid your travel to the job generally must pay your way back, with some exceptions.
If you were fired vs if you quit
- Fired or laid off: Within 3 business days of your last day.
- You quit: By your next regularly scheduled payday. The date depends on your pay schedule, not on when you left.
Unused PTO — is it owed?
Only if your employer's written policy or agreement promises it. Alaska enforces an employer's own vacation rules: vacation pay is owed at separation only if a policy, promise or contract provides for it. Check your handbook, offer letter or any PTO policy you signed; if it says accrued time is paid out, that promise is enforceable.
What happens if they are late
An employer that pays late may owe your regular wage from the time you demand payment until it pays, for up to 90 working days (AS 23.05.140(d)). The penalty is mandatory when the Department brings the claim.
How to file a claim in Alaska
Send a Wage Claim packet to the Alaska Department of Labor and Workforce Development, Wage and Hour — statewide.wagehour@alaska.gov. File within 2 years for overtime or minimum wage, 3 years for straight-time wages. Filing is free, and you do not need a lawyer.
- Ask in writing first. Email creates a dated record.
- Send a short demand letter naming the amount, the deadline, and any penalty that applies in Alaska.

Alaska final paycheck: common questions
Can they hold my last check until I return my equipment?
No. In Alaska your final wages are due by the deadline on this page whether or not you have returned a laptop, uniform or keys. Your employer can ask for the equipment back or pursue its cost separately, but federal law bars deductions for it that would cut your pay below minimum wage or eat into overtime.
Do I get paid for unused vacation?

No wages are forfeited, but notice sets the clock. In Alaska, final pay for a worker who quits is due on the next regular payday that falls at least 3 days after your employer received your notice. With no notice at all, the deadline is counted from when your employer learns that you have quit.
When is my final paycheck due in Alaska if I am fired?
