The deadline, and what it depends on
When your employer ends the job, the deadline depends only on your last day. When you end it, it depends on how much notice you gave.
If conditions at the time of discharge prevent paying on the spot, wages are due the next working day. If you quit with at least one pay period's notice, you are paid on your last day. The extra amount applies where the employer had no equitable justification, and the employer also owes the state a penalty of at least $500, or $100 per violation if that is more.
If you were fired vs if you quit
- Fired or laid off: Immediately — final wages are due on your last day.
- You quit: By your next regularly scheduled payday. The date depends on your pay schedule, not on when you left.
Unused PTO — is it owed?
Only if your employer's written policy or agreement promises it. Hawaii does not require paid vacation. Employers that offer it must give the policy in writing or post it, and that policy decides whether unused vacation is paid at separation. Check your handbook, offer letter or any PTO policy you signed; if it says accrued time is paid out, that promise is enforceable.
What happens if they are late
Liquidated damages equal to the unpaid wages, on top of the wages themselves.
How to file a claim in Hawaii
File a signed written complaint with the Hawaii DLIR Wage Standards Division within 1 year of the wages becoming due. Filing is free, and you do not need a lawyer.
- Ask in writing first. Email creates a dated record.
- Send a short demand letter naming the amount, the deadline, and any penalty that applies in Hawaii.

Hawaii final paycheck: common questions
Can they hold my last check until I return my equipment?
No. In Hawaii your final wages are due by the deadline on this page whether or not you have returned a laptop, uniform or keys. Your employer can ask for the equipment back or pursue its cost separately, but federal law bars deductions for it that would cut your pay below minimum wage or eat into overtime.

When is my final paycheck due in Hawaii if I am fired?
