The deadline, and what it depends on
When your employer ends the job, the deadline depends only on your last day. When you end it, it depends on how much notice you gave.
The demand must be in writing: without one, the 24-hour clock and the 15-day penalty never start. If the first payday after you quit falls less than 5 days after your last day, the employer may use the second payday, but never more than 20 days. If you handled money or property for the employer, it gets 10 extra days to audit the accounts first. A commission salesperson who is an independent contractor has a separate deadline of 3 working days, or 6 without 5 days' written notice.
If you were fired vs if you quit
- Fired or laid off: Immediately — final wages are due on your last day.
- You quit: By your next regularly scheduled payday. The date depends on your pay schedule, not on when you left.
Unused PTO — is it owed?
Only if your employer's written policy or agreement promises it. Minnesota law does not require a vacation or PTO payout; company policy decides. Where a policy does promise it, the benefit is payable within 30 days of becoming due and can be claimed in conciliation court. Check your handbook or offer letter for what it promises.
What happens if they are late
Your daily wage continues as a penalty for each day the final paycheck is late, up to 15 days.
How to file a claim in Minnesota

- Ask in writing first. Email creates a dated record.
- Send a short demand letter naming the amount, the deadline, and any penalty that applies in Minnesota.
- File the wage claim. Keep copies of pay stubs and your schedule — the time card calculator can total the unpaid hours for you.
Minnesota final paycheck: common questions
Can they hold my last check until I return my equipment?
No. In Minnesota your final wages are due by the deadline on this page whether or not you have returned a laptop, uniform or keys. Your employer can ask for the equipment back or pursue its cost separately, but federal law bars deductions for it that would cut your pay below minimum wage or eat into overtime.
Do I get paid for unused vacation?
