The deadline, and what it depends on
When your employer ends the job, the deadline depends only on your last day. When you end it, it depends on how much notice you gave.
If you were fired, the employer has 3 days before the penalty starts; if you quit, it starts on the day payment was due. A temporary layoff also makes wages due immediately, but a suspension, being placed on call or an approved leave of absence does not. Hiding to avoid payment, or refusing money properly offered, stops the penalty for that time.
If you were fired vs if you quit
- Fired or laid off: Immediately — final wages are due on your last day.
- You quit: By your next regular payday or within 7 calendar days of your last day, whichever comes first.
Unused PTO — is it owed?
Only if your employer's written policy or agreement promises it. Nevada does not require unused paid leave to be cashed out when you leave; the employer may choose to. If you are rehired within 90 days and did not quit voluntarily, unused hours must be restored. Check your handbook or offer letter for what it promises.
What happens if they are late
Your daily wage continues as a penalty for each day the final paycheck is late, up to 30 days.
How to file a claim in Nevada
File a wage claim with the Nevada Office of the Labor Commissioner. A civil action must be brought within 2 years of the failure to pay (NRS 608.135). Filing is free, and you do not need a lawyer.
- Ask in writing first. Email creates a dated record.
- Send a short demand letter naming the amount, the deadline, and any penalty that applies in Nevada.
- File the wage claim. Keep copies of pay stubs and your schedule — the time card calculator can total the unpaid hours for you.
Nevada final paycheck: common questions
Can they hold my last check until I return my equipment?
No. In Nevada your final wages are due by the deadline on this page whether or not you have returned a laptop, uniform or keys. Your employer can ask for the equipment back or pursue its cost separately, but federal law bars deductions for it that would cut your pay below minimum wage or eat into overtime.
Do I get paid for unused vacation?
